Startachat Terms of Service and User Service Agreement
By purchasing our services, you agree that all terms and conditions highlighted in this User Agreement and Terms and Conditions will apply to you. This constitutes a legally binding agreement between Startachat and (the client, “You”).
Service Agreement
During the term of this Agreement, Startachat will provide the service to you as described below hereto (the “Services”).
It’s important that you ( the client) understand the expectations of the service plan you have purchased so you know what to expect.
- Charges and Fees
You shall be required to pay for use of the services that Startachat provides to you. You shall pay to Startachat the amounts and payment schedule specified on the plan purchased on the Startachat website or specified below
Product Description
Startachat provides a service that accumulates leads from members of the public who are looking to sell their vehicles. We validate phone numbers to ensure that the leads are genuine; however, we do not guarantee the sale of vehicles resulting from these leads.
- Payment policy
For all Subscription Plans you purchase, You agree and acknowledge that you will be charged the amount on the subscription renewal date of every month following signing up, regardless of the results or return you have received unless you request to cancel with at least 48 hours notice to your renewal date. This is because the product is a rolling monthly subscription and is auto charged monthly to prevent any disruptions to your service.
You agree and acknowledge that you will be legally bound by this payment policy and liable to pay these charges to Startachat by the enforcement of the jurisdiction and laws of England and Wales. And if not paid you could be summoned to the courts of England and Wales by Startachat for a claim of these fees plus further compensation for refusal and delay of payment if not paid at the time Startachat requires.
- No Service Guarantees
During the term of this Agreement, you agree and acknowledge that Startachat does not promise any service guarantees for the Subscriptions and Lead generation plans. Startachat sets average rates of performances, based on averages of other similar client campaigns; however these are just for illustrative purposes and Startachat cannot assure it will be the same for your campaign or guaranteed for your particular use case. This relates to the amount of prospects contacted, amount of leads generated, appointments booked and deals closed per month. Startachat upholds the promise that they will try their best to achieve the best results possible for your business, however there is not a guaranteed ROI or delivery promise to you and you acknowledge and accept this policy by using and receiving the services at Startachat.
- No Refund Policy
By purchasing our services, you agree and acknowledge that Startachat does not provide any refunds at any time post purchase.
This applies to all Plans
Startachat does not provide refunds since its product and services incur costs when the customer agrees to its services and therefore cannot supply a refund once purchased. Startachat supplies its service on a “AS IS” basis with a “No Liability” Clause in the Service Agreement and expressly claims that the service can have disruptions and issues, due to the nature of its service and its customers must be aware and accepting of that. So the customer cannot request a refund after initiating the services
- Termination/ Cancellation Policy
You agree and acknowledge that once you purchase one of Startachat’s services you must follow and abide by the correct Termination and Cancellation Policy set by Startachat in order to cancel your service plan correctly and to avoid further charges. The following termination and cancellation rules apply:
In order to cancel a service plan with Startachat, you must send a cancellation notice in writing by email to the Startachat Billing Team at info@Startachat.co.uk. We do not accept a message via slack or email as this does not constitute an official cancellation notice. This must be sent to the Startachat billing team at least 48 hours (2 days) before your renewal date to be accepted. Startachat does not allow same day or 24 hour cancellation notices. This is due to the reason it takes at least 48 hours for our systems to cancel and delete your account and database and it will incur Startachat costs if not deleted within this window.
You agree and acknowledge that if you request an early termination, you will not be paid or compensated for any portion of the Subscription that will not be delivered Alternatively, if this is a pay-per-appointment service, you will be responsible for covering the outstanding balance corresponding to the agreed number of appointments within a batch
Should you delay or default in a payment, such as not paying your owed payment to Startachat at the due time, Startachat may terminate your Agreement, Campaigns and service plan immediately without notice and at any time. Startachat will not be liable for any compensation, loss of data, refunds or any liabilities for canceling your account.
- Non-Solicitation Covenant to Startachat Contractors and Employees
You agree and acknowledge that by purchasing our services and entering into this User Service Agreement you are legally bound to not work directly or indirectly with Startachat’s contractors, employees, or service providers who provide the Startachat services for the client for a period of 1 year.
You agree that you will not approach, contact or try to poach any of Startachat’s team members or service providers outside of their working relationship during, or after working with Startachat for a period of up to 1 year. This is a legally binding contract and must be adhered to by accepting this clause. Failure to do so will result in legal action and penalties.
- Sole Agreement
This Agreement, constitutes the sole agreement of the parties and supersedes all oral negotiations and prior writings with respect to the subject matter hereof.
- Choice of Law
The validity, interpretation, construction and performance of this Agreement shall be governed by the laws of England and Wales.
- Agreement and Signatures of the Parties of the Agreement
By Making a payment on the Stripe portal you officially declare you agree and accept to the terms of this agreement and this digital representation can be accepted as a legally binding signatory to the terms of the Startachat Terms of Service and Service Agreement.
This agreement will take effect from the date that you have signed up to your service.
